Once we publish to the internet it can get legs really fast.   We have to think that ANYTHING we publish online can be pulled down and distributed and redistributed by other media.  This is a lesson that Ashley Alexandra Dupre is finding out very quickly.  While she might consider herself an entertainer or a musician we in the general public consider her NEWS.  Ashley Alexandra Dupre is linked to Governor Eliot Spitzer and his engagement with The Emperor’s Club, a high end escort service.

I would be willing to bet (I’m not a lawyer) that MySpace (owned by NewsCorp….as in FoxNews) has provisions in their terms and conditions that release them from any wrong doing or illegal distribution, or third party re-distribution, and I bet that Ms. Dupre clicked on the ACCEPT button when she registered for a MySpace account.  (I am not going to waste my time looking this stuff up, but once it is out there anyone can have access to it and if you want to right the wrong it will cost a small fortune and keep a team of attorney’s busy for decades, and I’ve never heard of any attorney who ran up hours for the sake of frugalness).

As reported in the New York Times, "Her attorney, Don D. Buchwald, said she did not consent to the use of her photos in this manner, and the usage may be a violation of federal copyright laws. He said the photos have appeared on commercial Web sites without her consent."

Social media/social networking what ever you want to call it, is going to change the behavior of some, if not many.  The point to all of this is we are living in glass houses including Eliot Spitzer and Ashley Alexandra Dupre, I think that we just have to start getting used to it.  If she wants to sue the media outlets who re-distributed her photos she will have a very long list of folks to keep her legal team busy with.  Ashley Alexandra Dupre is now an instant celebrity weather she likes it or not.
